Importation, distribution, supply and sale of Tobacco Products

 Electronic Cigarettes

In accordance with the Tobacco (Smoking Control) Act, 1986 it is being notified that electronic cigarettes are defined as tobacco products. As such, electronic cigarettes have to comply with all the provision of the Tobacco (Smoking Control) Act and its subsidiary legislation. The list of relevant legislation can be found at the Health Promotion and Disease Prevention Department website.

The Department for Environmental Health would like to bring to the attention of all importers that the designated points of control in terms of Commission Decision 2008/798/EC as amended by Commission Decision 2008/921/EC imposing special conditions governing the import of products containing milk, milk products, soya or soya products originating in or consigned from China, are the following:

Animal feedingstuffs

• Border Inspection Posts at Malta Freeport and Luqa Airport

Other foodstuffs including products containing milk and soya products

• Documentary Checks - Port Health Services, Floriana

• Identity and Physical Checks - Examination Shed, Hal-Far

There is no authorisation for the importation into the EU of milk and dairy products produced in China.

Specific measures are in place for imports of certain foodstuffs from specified countries to reduce known human or animal health risks. The products mentioned in the table are subject to specific controls and procedures for import.
